acquired immune deficiency syndrome, acquired immune deficiency syndrome

(1) The Legislature finds and
declares that persons infected or believed to be infected with human
immunodeficiency virus have suffered and will continue to suffer irrational
and scientifically unfounded discrimination. The Legislature further finds
and declares that society itself is harmed by this discrimination, as
otherwise able-bodied persons are deprived of the means of supporting
themselves, providing for their own health care, housing themselves, and
participating in the opportunities otherwise available to them in society. The
Legislature further finds and declares that remedies are needed to correct

as having acquired immune deficiency syndrome, acquired immune deficiency
syndrome related complex, or human immunodeficiency virus shall have every

(a) No
person may require an individual to take a human immunodeficiency
virus-related test as a condition of hiring, promotion, or continued
employment unless the absence of human immunodeficiency virus infection is a
bona fide occupational qualification for the job in question. 除非未感染HIV是系爭工作真正必要的資格要件,否則任何人不得要求個人進行HIV相關篩檢作為雇用、升遷或持續雇用的條件。 (b) No person may fail or refuse
to hire or discharge any individual, segregate or classify any individual in
any way which would deprive or tend to deprive that individual of employment
opportunities or adversely affect his status as an employee, or otherwise
discriminate against any individual with respect to compensation, terms,
conditions, or privileges of employment on the basis of knowledge or belief
that the individual has taken a human immunodeficiency virus test or the
results or perceived results of such test unless the absence of human
immunodeficiency virus infection is a bona fide occupational qualification of
the job in question. 任何人不得因為一個人接受HIV篩檢、或HIV篩檢之結果或察覺之結果而拒絕雇用或解雇該個人,亦不得以因此以剝奪其雇用機會或有此傾向之方法,或者其他會影響其受僱者地位、或將會造成補償、雇用時程、工作條件或者受僱權利歧視之方式而隔離或階級化個人,除非無HIV感染是該工作真正之必要條件。 (c) A person who asserts that a
bona fide occupational qualification exists for human immunodeficiency
virus-related testing shall have the burden of proving that: 任何人主張HIV相關篩檢(結果)是特定工作之真正必要條件者,必須負舉證責任: 1.The human immunodeficiency
virus-related test is necessary to ascertain whether an employee is currently
able to perform in a reasonable manner the duties of the particular job or
whether an employee will present a significant risk of transmitting human
immunodeficiency virus infection to other persons in the course of normal
work activities; and HIV相關篩檢是確定一個受雇者是否可以合理執行特定工作任務所必須,或是一個受雇者有在一般工作的過程將HIV傳染給其他人之重大風險,並且 2.There exists no means of
reasonable accommodation short of requiring that the individual be free of

(a) A
person may not discriminate against an otherwise qualified individual in
housing, public accommodations, or governmental services on the basis of the
fact that such individual is, or is regarded as being, infected with human
immunodeficiency virus. 任何人不得以基於此個人為--或是被視為--有感染HIV病毒之事實,歧視具有居住、公開投宿、或政府設施等資格之個人。 (b) A person or other entity
receiving or benefiting from state financial assistance may not discriminate
against an otherwise qualified individual on the basis of the fact that such
individual is, or is regarded as being, infected with human immunodeficiency
virus. 接受國家財政協助或從中獲益的人或個體,不得以HIV感染之事實或懷疑作為基礎歧視原本資格符合之人。 (c) A person who asserts that an
individual who is infected with human immunodeficiency virus is not otherwise
qualified shall have the burden of proving that no reasonable accommodation
can be made to prevent the likelihood that the individual will, under the
circumstances involved, expose other individuals to a significant possibility
of being infected with human immunodeficiency virus. 主張一個人因為感染HIV而不適格之人,必須舉證證明無其他合理變通辦法可以避免該人在系爭環境下使其他人暴露於感染HIV之重大可能性中。 (d) A person may not fail or
refuse to hire or discharge any individual, segregate or classify any
individual in any way which would deprive or tend to deprive that individual
of employment opportunities or adversely affect his or her status as an
employee, or otherwise discriminate against any individual with respect to
compensation, terms, conditions, or privileges of employment on the basis of
the fact that the individual is a licensed health care professional or health
care worker who treats or provides patient care to persons infected with
human immunodeficiency virus. 任何人不得因為有執照之健康照護專業人士或醫療工作者診治HIV感染者或提供予健康照護,而拒絕雇用或解雇該個人,亦不得因此以剝奪其雇用機會或有此傾向之方法,或者其他會影響其受僱者地位、或將會造成補償、雇用時程、工作條件或者受僱權利方面歧視之方式而隔離或階級化個人。 (5) Every employer who provides or
administers health insurance benefits or life insurance benefits to its
employees shall maintain the confidentiality of information relating to the
medical condition or status of any person covered by such insurance benefits.
Such information in the possession of a public employer is exempt from the
provisions of s. 119.07(1) and s. 24(a), Art. I of the State Constitution.
This exemption is subject to the Open Government Sunset Review Act in
accordance with [Footnote 1] s. 119.14. An employer shall be liable in
damages to any person damaged by its failure to implement such a procedure. 凡是提供或是主管對於其員工健康保險福利或人壽保險福利之每位雇主必須維持與受此保險福利保障之任何個人的醫療情況或狀態相關之資訊機密性。任何公眾雇主持有之資訊豁免於s. 119.07(1) and s. 24,

(a) Any
person aggrieved by a violation of this section shall have a right of action
in the circuit court and may recover for each violation: 任何因本章節違背而受到侵害的人,享有訴訟資格並可對每一個違法行為要求回復原狀: 1.Against any person who
violates a provision of this section, liquidated damages of $1,000 or actual
damages, whichever is greater. 向任何違犯本章節條款之人請求1000元之金錢賠償或是高於此數目之實際損害的賠償。 2.Against any person who
intentionally or recklessly violates a provision of this section, liquidated
damages of $5,000 or actual damages, whichever is greater. 向任何有意圖或過失違犯本章節條款的人請求5000元金錢賠償或高於此數目之實際損害的賠償。 3.Reasonable
attorney's fees 合理的律師費用。 4.Such other relief, including an injunction, as the
court may deem appropriate. 任何其他法院認為適當之救濟,包含強制令。 (b) Nothing in this section limits
the right of the person aggrieved by a violation of this section to recover
