美國反PVC行動網的公開信 Open Letter PVC Campaign

2009年，美國司法部和台塑公司以1,300萬美元的罰金達成和解，因為台塑在路易斯安那和德州的工廠都爆發「廣泛」違規之情事。美國司法部指出：「環保署發現廣泛違反清淨空氣法案洩漏偵測及修復之情事，包括無法適切監控物質洩漏、無法將化學品製造設備納入洩漏偵測及修復計畫，也無法及時修復洩漏的設備。同時，調查人員在這兩間工廠都發現多種違反有害廢棄物規定之情事。此外，調查人員發現台塑排放的廢水超出其所持有的清潔水法許可（CWA permits），且德州工廠無法符合清淨空氣法案要求的含苯廢棄物操作規定，同時未將正確的毒物排放報告呈交環保署。」

台塑工廠已經不是第一次出問題，尤其台塑德州廠更是累犯。

新近一份研究報告發現，台塑工廠下風處的一群母牛發生DNA受損的現象。
這群DNA受損的母牛習慣在工廠周圍活動，在工廠邊和下風處的母牛受到的傷害最大，染色體結構改變和其他基因損傷將提高動物罹患癌症的風險，同時也可能造成生殖機能受損。(閱讀全文)

台塑公司，我們在此公開頒發黑星球獎的理由，並請社會共同檢視。

1.你們無視人權、民主，唯利是圖
1989年，中國人民解放軍血腥鎮壓在北京天安門發生的學生運動，史稱六四事件。在國際譁然、外商止步之際，而你們，是事件之後第一個到中國投資的大財團，全然無視普世追求的人權與民主價值。

2.你們製造的商品危害全球
身為全球最大的PVC粉生產廠，你們將產品賣給被全球各地的廠商，讓PVC廣泛使用在數不盡的塑膠水管、地板、醫療用品、玩具和鞋類、文具等產品中，不知不覺中影響下一代的健康。儘管全球均已知曉PVC的整個生命週期都會對環境產生危害，比如PVC的生產與廢棄是戴奧辛的主要來源，PVC的鄰苯二甲酸酯類塑化劑為環境荷爾蒙，會干擾人體內分泌，使男性雌性化，女性罹患乳腺癌機率增加，但你們還是繼續「向錢看齊」。

3.你們搾乾了台灣第一大河．濁水溪
你們財大勢大，迫使政府在濁水溪上游興建集集攔河堰，專管直送六輕廠每日34.5萬噸的用水。搶奪了農業用水，迫使農民抽用地下水，加速地層下陷；搾乾台灣第一大河，導致河川生態丕變，中台灣的沙塵暴更為嚴重。(閱讀全文)

We deliver this award to the Formosa Plastics Group for the reasons set out in this open letter in order that your true nature can be seen by all sectors of society.

1. Profits Before Human Rights; Profits Before Democracy
In 1989 the People’s Liberation Army bloodily suppressed a student movement in Tian An Men Square in what has come to be known as the Tian An Men Massacre. While the world gasped at the atrocities committed by the Chinese government and all foreign commerce and investment came to a halt, your enterprise, the Formosa Plastics Group became the first major company to invest in China without any thought or concern for the severe human rights abuses of your host. You displayed absolute disregard for democratic principles and indeed you profit from the butcher’s of Beijing.

2. “Formosa Plastics: We Make the Earth Miserable”
As the worlds largest producer of PVC you have spread your products around the world by giving producers of plastic piping, flooring, medial products, toys, shoes, stationary products and all other manner of goods, the means to befoul the health of present and future generations. The dangers of PVC throughout its life cycle are well established, including the fact that the production and disposal sites all contain high concentrations of dioxin and are sources for endocrine disruptors and environmental hormones causing sex changes in men and increases in the incidence of breast cancer in women. Yet despite the international consensus, Formosa Plastics, your attention has only one target and one goal – make as much money as possible with as little attention and expenditure on the social and natural environments. 德國倫理暨經濟基金會給台塑關係企業的公開信Open letter to the Formosa Plastics Group

面對法律與社會秩序、生態與和平、社會正義與人權，以及安全製造生產與環境保護，應該為此負責的台塑集團，其多位執行長的態度可以從美國達拉瓦州事件一窺究竟。因為當地執法單位無法親自送交法律禁制令，他們只好從直昇機上將法院命令丟進工廠裡。但即使這些永無止盡的罰單，累計罰金已經高達一百萬美元，還是無法改變台塑的態度。該公司對環境造成如此巨大的破壞，甚至是化學廠的美方貿易夥伴美國化學學會，都拒絕再與台塑集團合作。

在世界各地不同國家都展開大規模抗議行動，在台灣至今仍不斷上演抗議台塑集團的示威活動，不過這些執行長們似乎也不太在乎。

王家的成員、台塑集團董事長李志村以及台塑集團的董事會，都必須為這所有寡廉鮮恥的行為負責，我們要責怪他們危害人類健康、大規模毀壞環境，甚至奪走無數人命。台塑集團不但對和平及人權造成威脅，也迫害到民主、生態及一般大眾，因為他們一切行為只為個人利益著想，他們摒棄道德與良知，甘願讓我們的星球墮落成一顆「黑色星球」。(閱讀全文)

The attitude of the responsible executives of FORMOSA PLASICS GROUP towards law and order, ecology and peace, social and human rights, as well as towards production security and environment protection are revealed by an example from Delaware in the US. Since the authorities there were unable to deliver legal restraints in person, they had to drop them on the factory premises from a helicopter instead. Nor has the endless list of fines up to one million dollars resulted in a change of attitude. The responsible executives have cared just as little about the massive protests in various countries around the world. In Taiwan, there were even repeated mass demonstrations against FORMOSA PLASTICS GROUP.

The company is damaging the environment to such an extent that even the US-American trade association of the chemistry industry, the American Chemical Society, denies FPG its cooperation.(Read More)

德州職災受害工人團體抗議台塑聲稱生產對健康與環境無顯著影響Texas Injured Workers Group Disputes Formosa Plastics’ Claim of No Sign

根據2009年9月29日最新公布的1300萬美元同意判決書，環保局在德州康福港台塑塑膠工廠的稽查員，發現眾多違反清淨空氣條例中監測外洩及處理善後的方法，包括未能妥當監測氣體外洩機件（一座廠房有五百台），未能將化學加工設備納入氣體外洩監測及修繕程序中，並未能即時修復氣體外洩設備。稽查員同時發現「重度」違反氣體外洩監測及處理善後的情況，以及廠房違法處理有毒廢棄物及違法排放廢水。

職災受害工人團體引述自己親身在廠房內的工作經歷。一位工人過去在台塑內負責每日記錄氯乙烯的外洩量，他說外洩量的範圍從百萬分之1.2、7、13、35、177、987，一直到2053都有，而且打從他在那裡工作，二十多年來每年、每天、每個小時都是這樣。另一個工人在台塑的最後一項工作，是要他將四噸的氯乙烯外洩竄改為不到三磅，之後公司將這數據交給環保局。氯乙烯是一種可能致癌物質，會傷害肝臟、大腦、肺臟和造血器官，並且與神經損害有關係。職業安全健康局要求，工人不得暴露在氯乙烯濃度超過百萬分之一的環境超過八小時。(閱讀全文)

According to the recent $13 Million Consent Decree in September 29, 2009, EPA investigators at the Formosa Plastics facility in Point Comfort, Texas found extensive Clear Air Act leak detection and repair violations, including failure to properly monitor leaking components (500 in one unit), failure to include chemical manufacturing equipment in its leak detection and repair program, and failure to timely repair leaking equipment. The inspectors also found “extensive” leak detection and repair violation, as well as other hazardous waste violations at the site and wastewater discharge violations.

The injured workers group cited their own working experience within the facility. One worker was involved in Formosa’s daily logging of vinyl chloride leaks. He said the leaks ranged from 1.2 to 7 to 13 to 35 to 177 to 987 to 2,053 parts per million (ppm) and this for every hour of every day of every year of the 20+years that he worked there. . Another worker’s last act at Formosa was after he was told to falsify a four-ton vinyl chloride release that the company later reported as less than 3 pounds to the EPA. Vinyl chloride is a potent carcinogenic that targets the liver, brain, lungs, blood forming organs, and is linked to neurological damage. OSHA requires that a worker not be exposed to vinyl chloride over 1ppm averaged over any 8-hour period.(Read More)

言論自由的淪陷　從一個無「恥」的廣告開始

環保團體刊登公車廣告以斗大的紅色「恥」字「宣傳」台塑集團獲國際頒發「黑星球獎」，兩天內，先是台塑集團揚言控告客運公司和廣告媒體，隨後車身上紅色「恥」字被挖掉了，19日廣告全被撤下。北市府公共運輸處一方面說「未送審因此要求下刊」、一方面說「送審版本前後不符」。此次本於公益目的廣告刊登行為，究竟遭遇威權時代的實質內容審查，還是外力干預言論自由，民間團體認為茲事體大，有持續追究必要。(閱讀全文)
